“The more important point is that we do not necessarily have strictly
halakhic tools to discuss the status of these unnatural beings. Therefore,
we need to access our aggadic tools. By exploring our midrashic,
homiletical and philosophical texts, we can find analogies and theories
that help us find the right categories and approaches to apply to these
unusual situations.”
My take is that “Halacha” has always had to deal with new technologies (for
those of a certain age think of artificial insemination or Corfam shoes),
but the fact that we do not have a Sanhedrin makes it much more of an
inelegant process. Even if they were on Sanhedrin, it seems to me that it’s
often in the case that we need to follow the logic of the Ramban on
kedoshim tihiyu that the torah can’t tell us what to do in every situation
but gives us guidance through what it does tell us to apply to new
situations.
I think that when one looks at some of the new technology responsa (e.g. on
fertility issues), while Medrashic sources are drawn on, it’s much more of
a halachic heart type of decision where the sources are marshalled only
after there’s clarity what the results should be.
