Oh, sorry, it is not my proposal.

Invoking PGYN to someone who breaks away from minhag dates back to the ge'onim.
and a number of sefarim imvoke it often in this context, like the Rama (eg YD 115:2),
the Taz (ad loc), the MA (496:4, etc...), the Chavos Yair, the AhS, the Noda BiYhidah
(I YD 54:2), etc, etc, etc...

Its applocation to "asher qidishanu bemitzvosav" to say Hashem told us we
must maintain our minhagim is at least as old as the Behag.

According to the Brisker Rav, yes - in that minhagim that contain the matbea
of a mitzvah are superior.a
