Correct.

Also correct.  Rashi says "d'tarud b'girsei v'lo b'milei d'tzibura."

The clauses don't match at all, and the word "tarud" is stative, or 
present passive, and does not -- cannot -- be talking about what he has 
or has not done in the past.
