It is true that the truth of the label will be undermined. When the second day of Pesach comes, the "Not Yoshon" will become false, as the contents of the package *will* be yoshon.
But is this a problem? As I see it, if it is a problem at all, it is a small one, because the passage of time will make this food *more* acceptable.
I think it is very admirable that the manufacturer is warning the consumer that it is chadash and people might not want to purchase this product. But the lack of an expiration date on the warning doesn't bother me. What harm is there?
The worst that could happen is that there might be some people who think that the food is *permanently* chadash, and therefore they won't eat it even after Pesach. While I do feel bad about their lack of knowledge and their loss of a good food product, I think there are bigger problems to worry about.
