From what I recall from learning Lulav haGazul... Yiush makes the item
the ganef's but does not make it any less geneivah. The lulav is still
assur mishum mitzvah haba'ah ba'aveirah.
So, IIUC, even if we can assume the author, artist or publisher is
meya'eish, how does that make it permissable?
